Welcome to United Family Caregivers! By accessing or using our services, including but not limited to our website (unitedfamilycaregivers.com), you agree to the following terms and conditions. If you do not agree, please do not use our services.
1. Nature of Services
United Family Caregivers is a non-medical homecare company providing support to families through the coordination of caregiving services. All services are non-medical, and no medical advice or treatment is provided.
2. Independent Contractor Status
All caregivers contracted through United Family Caregivers are classified as independent contractors (1099), not employees of United Family Caregivers ("the Company").
- Caregivers are responsible for complying with all applicable federal, state, and local tax laws, including income tax, Social Security, and Medicare contributions, which will be withheld and submitted by the Company.
- Caregivers are required to obtain and maintain their own liability insurance policies, listing United Family Caregivers as a secondary insured. Proof of insurance must be provided before services begin. The company may allow you to start services with the promise to gain insurance within a small reasonable amount of time.
3. Caregiver Responsibilities
Caregivers agree to:
- Follow the terms of their contract with United Family Caregivers.
- Comply with all applicable federal, state, and local laws governing caregiving services.
- Maintain valid and active insurance coverage as required by the Company.
- Maintain up-to-date certifications and licenses, including CPR certifications and any other certifications required under federal and state laws.
- Failure to comply with certification or licensing requirements will result in a breach of contract and indemnify the Company from any liability associated with caregiving services provided while the caregiver is uncertified or unlicensed.
- Report all incidents involving clients to United Family Caregivers within 24 hours.
- Maintain detailed records of client incidents for at least 10 years.
- Contact United Family Caregivers with any problems or concerns and provide the Company a reasonable opportunity to address the issue before reporting it to authorities, unless otherwise required by law.
- Take full responsibility for any harm or injury to clients caused by negligence or failure to comply with laws, regulations, or these Terms and Conditions.
- Notify the Company of any changes to personal health or address within a reasonable timeframe.
- Provide weekly reports (positive or negative) regarding caregiving services. Failure to provide a weekly report will result in indemnification of the Company from liability for any issues that arise during that week, in compliance with applicable laws.
4. Indemnification
Caregivers and users of this website agree to indemnify, defend, and hold harmless United Family Caregivers, its officers, employees, affiliates, and agents from and against any and all claims, damages, liabilities, losses, or expenses (including reasonable attorneys' fees) arising from:
- Breach of contract or failure to comply with these Terms and Conditions.
- Injuries, damages, or liabilities caused by the caregiver’s negligence, misconduct, or failure to maintain certifications or licenses.
- Failure to maintain valid insurance coverage.
- Unauthorized or improper use of the Company’s name, branding, or resources.
5. Consent to Recording and Communication
By using our services, you consent to:
- The recording of all phone calls for quality and legal purposes.
- The use of email addresses and other contact information to send communications on your behalf, within the scope of services provided and legal limitations.
- The use of your information in conjunction with our AI capabilities to improve service delivery and meet legal obligations.
6. Peer Mediation and Notice of Claims
In the event of any dispute between the caregiver or user and United Family Caregivers:
- Both parties agree to engage in peer mediation as a first attempt to resolve the issue.
- A 180-day notice of claim is required before filing any lawsuit against United Family Caregivers.
- Failure to comply with these provisions may result in dismissal of any legal claims.
7. Agreement to Terms
By signing a direct contract with United Family Caregivers, you acknowledge that you have read, understood, and agreed to all terms outlined in this document and on our website.
8. Additional Legal Protections
- United Family Caregivers assumes no liability for the actions of independent contractors, as they are not employees of the Company.
- The Company reserves the right to terminate any contract or service agreement without notice if terms are violated.
- All services are provided "as is," and the Company makes no warranties, express or implied, regarding the availability, quality, or outcomes of services.
- The Company is not responsible for any loss, injury, or damages resulting from caregiving services provided by independent contractors.
9. Governing Law
These Terms and Conditions are governed by the laws of the State. Any disputes will be resolved in the appropriate courts.
10. Modifications
United Family Caregivers reserves the right to modify these Terms and Conditions at any time without prior notice. Continued use of our services constitutes acceptance of any updates.
